Bounty hunter charged with attempted murder in shooting

A Mobile bounty hunter is charged with attempted murder in connection
with the Tuesday shooting of a Theodore man who was accused of
failing to appear in court, according to Mobile police.

Jeffery Scott Garrick received information Tuesday night about the
whereabouts of Nolan Wade Miles, 33, who was wanted for failing to
appear in court on felony charges of the possession and manufacture
of crystal methamphetamine, said Mobile police spokesman Cpl. Marcus
Young.

Garrick worked for A to Z Bail Bonds, Young said, but the bond he was
enforcing against Miles was issued by Bama Bail Bonds.

An employee at Bama Bail Bonds said Thursday that she could not check
whether the bond against Miles had been issued by the company. An A
to Z Bail Bonds employee said Thursday the company had no comment.

Garrick found Miles and an unidentified person in a white Jeep
Cherokee at about 9:30 Tuesday in front of the Jack O' Diamonds bar
on Government Boulevard west of Interstate 65, Young said.

Garrick stepped out of his vehicle, drew his .40-caliber pistol and
approached the white Jeep, Young said.

The driver backed the Jeep toward Garrick and struck the front of
Garrick's car, Young said.

Garrick then fired one shot into the vehicle and struck Miles in the
back, Young said.

Assistant District Attorney Ashley Rich said Thursday that the Mobile
County District Attorney's Office believes that Garrick used an
unreasonable amount of force in the situation, resulting in the
attempted murder charge.

"In the act of self-defense the law states that you're only allowed
to use that amount of force which is reasonable and necessary under
the circumstances," Rich said. "The bounty hunter pulled his vehicle
behind the suspect's car. He shot into the vehicle. ... The bounty
hunter did not act in self-defense."

After the shot was fired, the driver sped off and brought Miles to
the USA Knollwood Hospital, Young said. Miles was later transferred
to the University of South Alabama Medical Center, where he was
listed in serious condition as of Thursday evening, Young said.

Garrick called police Tuesday after the shooting and was questioned
and released pending the investigation, Young said. A warrant was
issued Thursday evening for Garrick's arrest, Young said.

According to court records, Garrick was charged in 2003 with unlawful
distribution of a controlled substance, but pleaded guilty to a
lesser charge of use and possession of drug paraphernalia.

Miles has pleaded guilty to reckless driving and driving with a
suspended license and has been arrested on charges of possessing and
manufacturing a controlled substance, court records show.

Under Alabama law, attempted murder is a Class A felony punishable by
10 years to life in prison.

Just last summer I think a guy went to prison in Florida for a very similar circumstance. He fired into a vehicle which had the skip he was wanting.

Not suppose to shoot unless the skip has a gun, Or running at you with a knife, Its idiots like him that is gonna mess it up for the rest of us.
Come on, He backed his car up, And hit the agents car?
Deffinatley NOT a reason to rip a .40 cal through dudes back.
Then it said the DRIVER drove the victim to the hospital?
So the skip wasnt even driving, So the agent cant even say the skip tried to kill him with his car, Because the skip was the passenger.

I never draw my weapon, I use mace or taser, but never fired them.Most people give up when you have a taser pointed at them, Or a big can of mace.

JUST A TIP, NEVER DRAW YOUR WEAPON UNLESS YOU KNOW FOR SURE THE SKIP HAS A WEAPPON!!!!!!!!!!!!!!!!!

WE MUST ALL REMEMBER WE HAVE NO RIGHT TO SHOOT A FLEEING FELON--DEADLY FORCE CAN ONLY BE USED IN DEFENSE OF OUR OR ANOTHERS LIFE PERIOD--

IN THIS CASE THE BEA DID NOT EVEN SHOOT THE DRIVER WHO HAD CONTROL OF THE VEHICLE--IT SOUNDS LIKE THE PASSENGER WAS NOT A DANGER TO THE BEA SO I BELIEVE THE BEA IS IN DEEP SH-T--IF THIS IS THE TRUE SENARIO THEN THE BEAS TRAINING WAS OVER RIDDEN BY HIS ADRENALIN RUSH OR HE WAS NOT PROPERLY TRAINED

DOES ANYBODY KNOW THIS BEA? IS HE A NEWBIE OR A SEASONED AGENT--THERE ALSO CAN BE SOME PART OF THE STORY WE DO NOT KNOW-LET'S SEE WHAT COMES OUT IN THE NEAR FUTURE

I urge everyone to become familiiar with your state's use of force, use of deadly force statutes. In most (if not every) states it will be as Hadley has stated. Utilizing the "reasonable person" standard, if you beleive that your life or the life of another is in jeopardy of imminent death or serious bodily injury. Or in some cases to prevent a forcible felony. Depends on the state. it does not mention from a gun or knife only. I have seen a guy cleared who shot a guy who attacked him with a road flare. BECOME FAMILIAR WITH YOUR STATE'S LAWS CONCERNING THIS. Then act with appropriate judgement.

As we are always taught "Reasonable Man". That is the one that is sitting in the jury box and what he thinks your fate should be. What would a reasonable man do in your position?

Yea, Reguardless, If the skip isnt pointing a weapon, Or object that can have fatal results.
Dont shoot

P.S i also seen were a guy was cleared after being attacked by a group of gang members
