This question or one similar came up on another website, Therefore I am putting it out here for commentary.

This was my comment:

This issue is a talking point and nothing more at this point in time. The first question is how would these recovery agents be licensed, trained and regulated to ensure public safety. The second question is who is going to pay bail enforcement agents for the recovery work, surely not the offenders or their families. We have a hard enough time trying to get them to pay the premiums on the original bond less more paying when the offender skips. Most of these offenders are under educated, low skilled and thus low paid. How can an offender be held liable to pay for this service if he lacks the proper resources to start with. The job of probation and parole should be left to the state insofar as the work involves more than just arresting offenders. If the state finds it needs to have a large amount of offenders recovered it could contract with private companies for apprehension services. IMHO...

Kinda odd this would come up. Last Thursday while in Court one of the Pro / Par folks quipped that they ought to give me their absconder list ;) . . . I chuckled . . . well that would be ok, but I do not work for free :)

I know we have talked about this before and some of the major issues are,

1) Required training, education
2) Liability, who pays for the law suits
3) When are you a State actor or private citizen
4) Access to LE resources
5) What PO would give up their job security?

I don't think this will ever happen on a large scale. Maybe on a case by case basis by some local court or probabtion offfice.

Too much liabilty to figure out.

I don't see it as a good idea. I also don't see it as needed. I am not a fan of LE contracting out work like that. I think it is one thing to have Avalon employees doing desk security at the county jail, but it is quite another to have John Doe's recovery firm executing your warrants. Too many things come into play.

There would be a lot of liability for the county or state, not to mention legal issues that would sit outside of the existing framework of bail fugitive recovery statutes and case law.

In my opinion it could put the whole industry at risk, and perhaps lead to regulations that would place an unsustainable financial burden on people in the industry. In which case the industry would disappear or become monopolized by big corporations with deep pockets i.e. CCA, Wackenhut etc...

I would be very much against any such effort for the aforementioned reasons.
