TWO SUPERIOR COURT JUDGES IN A COUNTY THAT I WRITE IN ISSUE WARRANTS BUT DO NOT SEND BOND FORFEITURES ON FTA'S. I SPOKE WITH THE COUNTY CLERK AND SHE HAS APPROACHED THE JUDGES ABOUT THIS AND IN HER WORDS SHE "GOT HER HEAD BITTEN OFF" BY THESE JUDGES FOR QUESTIONING THEM.
NOW....HERE IS MY QUESTION TO ALL OF YOU.
SINCE A BOND FORFEITURE ORDER WAS NOT ISSUED HOW MANY OF YOU STILL PURSUE THE DEFENDANT FOR FAILURE TO APPEAR ON A BOND THAT YOU WROTE.
I HAVE SPOKE WITH SEVERAL BONDSMAN IN MY AREA AND THEY ALL FEEL DIFFERENTLY, SOME FORGET ABOUT THEM AND OTHERS STILL PURSUE THEIR FTA'S.

Mark do they request payment on the bond?--if no why chase the skip down and incur possible liability issues--if the court does not want them or the money why care-what happens if a screw up occurs while hunting these skips-your butt is in a sling--let the sheriff or pd do it

They do not request payment on the bond. I just recently found out about this. At the end of the year they send copies of all bonds written and court notices to all the bondsman in the county. This being my first year in this county I did not realize that these particular judges did not send out bond forfeiture notices. We do not plan on pursuing the FTA'S although I did speak with one of them and he decided to turn himself in after speaking with me.

I have a few municipalities that don't send bond forfeitures. I started out looking for the skips till I found out I was the only one doing so. "UNTIL", two of the municipalities decided to start doing them. They needed extra income, so they came after the bonding companies. It took a few months, but we were able to round them up.
So my advice to you would be to not spend alot of money on the skips, if any. Phone work should be effective enough. Then, if the judge decides to do the forfeitures, you won't have as many to go after.

I have to agree with everyone here on this.
I know that it is tempting to pick them up just out of principle.
But in the end the liability out-weighs the satisifaction.
Now I will say this also....I have never heard of any municipality in Louisiana not issuing forfeitures.
I guess that is good though....I would be out of business.

I disagree.... It is just your luck that you forget about the skips because the court is not requesting money at this time. Then later down the road when they get their act together they approach you as the bondsman and tell you that you owe them all of the money for the FTA bonds.
As a bondsman to clear your name I would return to justice everyone who failed to appear on a bond that my name was signed to.
