Moral Issue

We are facing a moral issue at USRS.

We took an application last Friday of a gentleman who wants to become a Surety Agent/ FRA. We want to hire him due to his qualifications (Bi-lingual, Educated and knows insurance.) However, He has a Felony dating back over ten years (DUI).
According to Nebraska Dept. of Insurance and NAIC, He is eligible to be licensed as a surety underwriter (as long as he fills out a US 1033 form).

We are just worried that his felony will "HAMPER" his career in this field.

Any thoughts or sugestions ?

Not sure if it is more of a legal issue rather than a moral one.... depending on the state laws and requirements, he is either in or out....


but you already said you'd like to hire him so I think you have made the moral decision, now it would just be the legal one...


I would venture to say that most of us have things that might and often do "HAMPER" us in the field but we get past them.... he might make you a very good agent... but then again.......... who knows????? As you are aware, this is a very volatile occupation....


With the conviction over 10 years in the past... it appears that he has that under control, but of course, it is still out there.... frankly, and I am sure none of us are proud of it.... most of us that have ever had a drink, probably got behind the wheel one time or another and the only reason we didn't get a DUI at that time was probably luck... I haven't done it lately but I, as many, have had our day... just luck of the draw and at my age now... I know better.

When did a DUI become a felony ? In NC if you are caught driving under the influence several times (not sure the number) it can become an habitual charge, but one DUI ? Might want to check and see how that DUI became a felony.

TEXAS ~ A first DWI is a felony if there is a person 15 years or younger in the car, otherwise the first DWI is a misdemeanor.

However I did not look to see how long this has been in affect. I do recall seeing Billboards in 2008 (in Texas) that stated DWI in Texas = Felony

If it was just a regualr DUI, I don;t think that would be a henderance to hiring him.

If this "felony" included injuries or death, or was his 3rd or 4th DUI, even 10 years ago, I would have a problem.
