Deferred disposition?

Just wanted to bump this back into the light.... just finished another list of 'exonerations'.... I had a half dozen or so that had deferred dispositions... several with as much as 3 years!!!!! and nothing can be done other than my choosing to come off the bond with a bailpiece or staying on it and hoping the defendants stays straight.... this is an ongoing problem as discussed in this thread.

I will not go into this stuff again... suffice to say, it is a thorn in our bonding sides... and in Virginia there is not much we can do other than ride it out or lock em up... deferred disposition is not finalization and the courts here hold you on the bond till finalized.... 'too bad, so sad." as said by several judges... "your a bondsman, Mr. Marx, get used to it!!!".................... and IMHO.. .that is just BS..........

I think you should just surrender those defendants.
Yes judge your right it's to bad............for them.
How did that original case turn out?
Here in NY the bonds person can surrender anytime he/she wants, but there have been a couple of times for me where the judge refused even though the criminal procedure code says the judge MUST exonerate the bail upon surrender. In those cases I had the bondsmans' lawyer get a copy of those minutes where I clearly asked for exoneration according to the CPL, where the judge ruled against the written laws and keep it in the file that way if the defendant skips it should cover them.

So far, I have not lost one that was on deferred disp. but there is always the first time and it certainly puts me in a pickle... the thing about coming off the bond and locking them up is that I would have to spend time, effort and money to find and put them back and it would probably be money that may or may not be recovered... it is a toss up as to whether it would stand in court... I have had judges swing either way on this... I know one that said he would not hold me to it and another that said until the case was finalized, it would stand... so who knows... just another case of ................... "your a bondsman, get used to it."

I think that is the attitude pretty much anywhere on the deferreds. At least it is here.
