required by law here . . . NOT to do so . . .
16-84-114
(4) Any bail bond agent attempting to apprehend a defendant shall notify the local law enforcement agency or agencies with the defendant's name, charges, and suspected location.
(5) Any person who violates any provision of this section shall be guilty of a Class D felony.

makes one wonder where the due process lies :-)

You have to notify in MO. You would be surprised how many times the person answering the phone will ask why your calling. Most dont know the law. I always tell them to write it down and pass it along to the person in charge.

When out of my area or state, I always check in whether I have to or not. If its a small town, I like to find the PD and stop in. If its a city, just call.

Most times I have found that the small two to ten man agencies will assist you with the recovery insofar as it is the most action they have had all year. Also I like what Scott said, I been to some of those one horse towns like the he spoke of, both as a police officer and as a BEA, on those few occasions I have put the onus on the locals to help me get that shythead out of their town and back up north where we allow criminals to run free, and bad mouth their country.

Gene, I absolutely agree with the above assessment of the post question. Living in rural southside Virginia, I have found smaller departments to be much more helpful.

Had two plain clothes detectives not only go with me and one of my guys but took us right to the location that we did not actually know about at the time and locate the connection that led us to the skip. They actually went up to the door with us and stood with hands on their weapons while we did the talking.

Another small town in northern NC actually told us where the key to the police chiefs office was in case we wanted some coffee in the middle of the nite if we were in their town... absolutely a true story... now that is cooperation... of course, I always maintained complete professionalism with this and other departments. (Now see.... I can be very professional if need be... although my normal persona is a bit on the light side 8), I also have a serious side. )

This topic kinda falls into the category of "What would you rather explain, why you did or why you did not"

That little practice will clear up most tough decisions pretty quickly.

We are not required to notify LE, but it is usually best to do so. That way they know who and where you are, and either maybe won't bust you out, or will at least do a drive by to make sure you are okay and/or defend you against an over-eager neighbor-hood watch. When working outside our local area, or in other states, checking in with the locals works even better. Locals, especially in small towns often know more than we do, and are usually very willing to help.

I think it's great how so many people think we're "repo" guys when calling in, despite saying that we are "bonding recovery agents" (key word "BONDING"). The funniest phone call though involved a dispatcher who said in a very sweet voice that she hoped we got our "bad guy"...it reminded me of my grandma. There was one time where my partner called in his location and vehicle description and was almost detained because Gwinnett County thought HE was the fugitive.

Now ask him about Fayette County.....

We arrive at Fayette with our SIQ.....Rick leaves to get paperwork from the vehicle.....Jailers show up to get the SIQ......they look at me and say "Rick?"....I say "No. He went to get a few things from the vehicle.".....They run out and detain him in the parking lot, thinking he is the SIQ. I never could figure out who they thought was handcuffed and sitting next to me AND why they would think we would let a fugitive leave, unescorted. Lets just say that Rick was not happy about being "put on the ground".

I talked to him about it and he said the P.O.'d factor came out after the fact, but had fun screwing with the guy's head. What I said about my partner getting stopped by GCPD believing he was the fugitive was priceless though. Sometimes when they ask what kind of vehicle I'm repo'ing though (the newbies or those who have no idea what we do that take the call) I'd love to tell them "No no no, I'm not repo'ing a car, I'm repo'ing a PERSON".

Fun times right?

I learned something today that I did not know regarding Bounty Hunting in Kansas. This may be common knowledge to most but I was unaware so I thought I would share.

Pursuant to KSA 22-2809a(2)(b) a bounty hunter must alert local law enforcement in the city or county where the apprehension will be made. Also the necessary documents and I.D. need to be presented to LE before apprehension.

Any surety or agent of a surety, commonly referred to as a bounty hunter, who intends to apprehend any person in this state pursuant to K.S.A. 22-2809 and amendments thereto, or under similar authority from any other state, shall inform law enforcement authorities in the city or county in which such surety or agent of a surety intends such apprehension, before attempting such apprehension. The surety or agent of a surety shall present to the local law enforcement authorities a certified copy of the bond, a valid government-issued photo identification, written appointment of agency, if not the actual surety, and all other appropriate paperwork identifying the principal and the person to be apprehended. Local law enforcement may accompany the surety or agent.

When we took our Concealed Carry class, our trainer was nice enough to inform the guy teaching the class that we were going into the Bail Enforcement field. So the CC trainer did quite a bit of research and even came up with a couple things that we were unaware of. We thought we had all the laws memorized but there was a couple we didn't. I am originally from Texas (23 years) and have lived in Kansas for 5 years and it is unbelievable how different laws are in other states. We have been training for months and months and we still train twice a week and there is always something new that you can learn. Even though there are no certain licenses in Kansas that you need to do bounty hunting, I think you need to know everything you can know about anything to cover your butt as well as not becoming a liability to your bondsman.
I'm done rambling...sorry

Had to go into Myrtle Beach one time on a pickup.... first thing we did was go to the local LE and told them who and why and showed our paperwork... later that nite we were on a "sit and watch' and about once an hour, a plain car would ride by slowly checking us out... made us feel 'loved and safer' I suppose... we were parked in a church parking lot in my big Chevy diesel... it was a drug infested neighborhood and having LE on the prowl around us during the nite actually made me feel better at least...we did not get our skip that nite but after we left South Carolina... I discovered that we had all been "carrying" and were totally illegal in S.C. without that states permits... that could have proved rather difficult for us... but LE never ask and we never said... cooperation is always a good thing in my book... although there are pro's and con's to most anything.
