Are there any recovery agents out of South Carolina on these forums? I tried the search function but I am on my cell phone which makes it limited and difficult.

There aren't any listed in the agency directory. I believe that South Carolina is one of the states that have outlawed freelance bounty hunting.

The research I did showed South Carolina is just like Minnesota as in no regulations at all.

Did they recently change that?

If stopped by Law enforcement the first thing you'll be asked is "What is your interest in this re-arrest. If you tell them you are anybody but the person that wrote the bond or are appointed by the insurance company that wrote the bond you may wish you had dug deeper into the bail bond laws of South Carolina.

I'm only trying to help and if you choose to take what you posted as being the law in SC that is entirely up to you.

Suggestion, call the county sheriff before you attempt to make a re-arrest in SC. The info you cited is incorrect.

Section 3 states who has the authority to make a bail fugitive arrest.

3.Bail agent’s arrest authority. Code Of Laws Of South Carolina 1976 Annotated Title 38. Insurance Chapter 53. Bail Bondsmen And Runners § 38-53-60. Arrest of defendant.
For the purpose of surrendering the defendant, the surety may arrest him before the forfeiture of the undertaking or, by his written authority endorsed on a certified copy of the undertaking, may request any judicial officer to order the arrest of the defendant by the surety.


All section 4 states is that there are no specific education, training or regulation of "bounty hunters." That does not mean they can operate other than in accordance with sections 2 and 3 above.


4.Bounty hunter (fugitive apprehension) provisions: At this time, there appear to be no specific regulations for “Bounty Hunters” in the South Carolina statutes.

I will second the info from Bill Williams... I have done several pickups in the Myrtle Beach area and one or two in Charleston... I always notify LE when going in and always show them my paperwork... of course, I am the bondsman that was on the bond and once or twice, I had my son and son in law with me who both were also licensed as bondsman... they said that was ok but no bounty hunters per sa... actually LE helped us out but I think that was because we caught them at a local coffee shop and paid for their coffee and donuts but I believe BW is correct.... call first and verify what you can and cannot do... It used to be illegal to carry in SC with out an in-state issued permit but I think that has changed... depending on what state you are licensed as CCW... but again... call first.

LE actually came by and checked on us while we sat on a house... all night... just rode slowly by and waved... we were in a pretty rough neighborhood and it was fine with me that they kept an eye on us.... cause I'm a candy azz and need all the help I can get... especially when in a rough neighborhood.... and when we actually made the arrest, we waited till they vacated the house... I don't like kicking down doors and LE was sitting down the street watching... so what I am saying is that I think you need to have your ducks in a row and sometimes what is said on websites is not always what is right or wrong...

As I always say............. yes......... here it comes.................... "the rule of thumb is... there is no rule of thumb..."

... take Mr. Williams and Mr. Suggs advice and call ahead.... !!!!

The info is great, I appreciate it. I was looking for a SC agent because I am thinking of moving there and wanted to an an "in" for the industry down there before I move.
