They are, in fact, going after the wrong person. And even if they win, ICE will continue to do what they do. As a bail agent, "ICE-hold" is an all-too-common occurring dirty word.

Couple important little known facts about ICE holds.

Aladdin and other bail companies do in fact "force" the jail to accept the bond for people with ICE holds. They do it up in the Bay Area all the time.

Secondly, once a bond is accepted for a person with a ICE hold, that person is then immediatley turned over to ICE. If ICE decides to place a immigration bond amount, that person can post an immigration bond.

If ICE deports that person, that is that.

Some bail companies count on the fact that if they post a bond on an illegal with a ICE hold, 1 of 2 things will happen. In the majority of the times, the person is deported. So, bail bond company files motion and get off the bond.

Did not lose premium and no liability.

If the illegal has an immigration bond placed on them, they are released and can take care of both cases. Majority of the time, those that post an immgration bond, they will stay and go to the State court also. They are trying to stay in the country legally.

So, again little chance of FTAing on the local charges.

Another thing that happens at least in my AO, is once the local DA learns of the ICE hold, 95% of the time, unless they are very serious charges, the DA will not prosecute the case. They let ICE have them.

So, the local bond is never in jeopardy.

We have posted just a couple of bonds on illegals with ICE holds. In each case, the defendant then posted a immgration bond. We made sure that they used Gonzalez and Gonzalez.

That way if they skipped on the immgration bond, they would be looking for them also, not just me for the local case. In most cases, the local charges were never filed.

One mroe thing. Immigration hearings on the regular, non serious defendants, usually take at least a year but more commonly 2 to 3 years to settle.

So, the one possible drawback is if the local courts do file and the defendant has an immingration case also, you will have to keep track of them for a long time.

Yeah I learned all this for my bail employer but it's all too complex and a lil' dirty for me. ICE hold still means no bond as far as I'm concerned.

99 percent of the time we dont' bail them either with a ICE hold.

However we had several that insisted, with the advice from their attorney to post the local bond so that they could be then be immediatley turned over to ICE.

They usually already have an immigration attorney working on their status. So, we will post a local bond in that case as long as we get collateral and the co signers know that if the defendant gets deported before the local case is complete, they must:

1) Provide the certified docs from ICE that they were deported

2) That they will pay for any court costs association with getting the bond eoxnerated.

So far, in the few we posted, they settled their local court case with no problems at all.
