I've only been in the Recovery business for about 3 1/2 years, but I've been offered & have completed "Fugitive Recovery" jobs that didn't involve Bail Bondsman. I'm curious to know if this is simply considered PI work, giving the fact that the 'no hands on' rule applies.

I've done plenty of recoveries without going hands on, basically skip tracing and calling law enforcement to make the arrest. And I've also located skips in person and persuaded them to come with me without ever cuffing them or putting my hands on them. You can't always do this, and it doesn't happen often, but there are situations that call for this approach. i.e. it's the only legal option in "no hunt" states like KY, IL etc..

If you've never gone hands on to make an arrest in either Bail Fugitive recovery, Corrections or Law Enforcement, then I would suggest that you not represent yourself as having fugitive recovery experience, as it would likely be assumed that you have such experience.

It sounds like the term that best describes your experience is "Fugitive Skip Tracing" and this really is the hardest part of fugitive recovery.

We have seen an increase in business from family members that have posted 10% to the court bonds, which, by all standards of law, makes the signatory a bondsman, although not a professional one.

Seen a wee bit of that here . . . However, when the warrant is issued for a FTA, the LE are responsible for the Recovery and in no way will stand by and allow for another to do said Recovery (kidnapping) . . .

Here it is not kidnapping if the Indemnitor who posted the bond with the court, and is financially responsible to the court, hires you to recover their skip. It is no different than commercial bail.

Not a lot of it (Sheriffs Bonds / Property Bonds) done here, most is straight up Professional / Commercial . . .
Would definitely be an avenue to explore with the Legislature here. NOT the "bonding" but rather the "recovery of" said absconders from the Courts

Scott, do you "surrender" the same as tho it were a standard "surrender of Bail" ?

2 things here: 1st, sounds like he may be doing the "crimestoppers" thing. Skiptrace the fugitive then call the cops. Next, collect the cs reward.

2ndly, Al. mirrors Md. In this respect. Anyone who posts the bond then becomes the surety. They then have the right to revoke the bond and surrender the def. Anytime they want either themselves or via contracted agent.
