Questions & opinions on use of body video recorder

And here is my continuation of the TCA code for video surviellance.....
TCA code 39-13-601 through 39-13-605 supports my claim on video surviellance as well,being that the video being taken in a public place there is no "reasonable expectation" of privacy.It also states that photograph in those codes also stands for photograpic reproduction,still or moving,video tape or live transmission.
I however did not find anything that specificaly stated that video could not have voice in the state of TN.,but i understand there is a Federal law that states that you cant have audio on a HIDDEN camera which is located in title 18 section 2512.
Here is some more useful info and like everyone else says here please do your own research and dont take my words as law...
there are 37 states which allow “one party consent” recording of oral communications and they are: Alaska, Arkansas, Colorado, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, Wisconsin and Wyoming.
There are 12 states which definitely require all parties to a conversation to consent before it can be recorded and they are: California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Pennsylvania and Washington. (In California Law, there is an exception – you can Record an Audio Conversation with the consent of only one party if certain criminal activity (kidnapping, extortion, bribery or a violent felony) is involved.If anyone else that can enlighten me anymore on this topic please do so as I can always benefit in learning more.

The reason for looking this up yourself, is that when you are confronted by LE, your answer is without hesitation, because if you hesitate, it is because you are not sure of the law, and you should be. I apologize for just now commenting 3 pages into the post but I wanted to share my experience with recorders...

First off, Scott Mclean made a good point earlier about income and results versus "cool guy gear" and the ever-famous "Bat Belt". I do have a couple of recorders, but had them previously due to most of my college classes being lecture based and wanted something to help me study. I use voice recorders STRICTLY for the purposes of note taking. Now, when I came into this, it was also for CYA. We don't have female team members, and transporting females defendants can be very interesting if they are combative. But, as Scott and others have said, it's all about how you treat said defendant AND THOSE AROUND THEM.

I use a camera to record defendants who may cause me problems. I would like a camera to video-tape pulls so my boss/senior agent and I can discuss ways to improve our interviews and arrests. But, as (Scott I promise you at some point I will send you a $1 for each time I quote you), Scott said if you screw up, and try to cover it up, people will know, and you won't get the Nixon treatment of flying away on a helicopter with the wife, but rather a new companion named Bubba and a small cell courtesy of the county.

Like anything they are just a tool...but there is no reason to have one right off the bat. But the thinking of liability and CYA is important.

I spent less then $20 on amazon for my DVR/audio/video recorder and its only the size of a finger, clips on a pocket or hangs around the neck. Love it! I record all apprehensions and hold for 3 years. I also record the car ride on mini-tape and throw that in the file. I think its well worth the minor investment!

Not even LE transports a female any distance (unless they have "made" an arrest) without a female partner.
I would never use the services nor refer the services of anyone that transports females without a female partner. Camera or not. You may want to look into the Dangerous Criminals Act of 2000. That is the way that all transports should be made barring a simple pickup and take to the local Jail.
