Further, your use of a quote from Lincoln is superfluous to the discussion and does not address your question or apply to any of the responses provided you.

The individual has rights and transporting him/her across state lines may be a violation of their Civil Rights, in that it would preclude them from their right to fight formal extradition proceedings. Per your initial post, you intend to re-arrest the subject in 1 state and then transport him/her to another. UCEA applies as the only states that did not sign that agreement were MO and SC. You see, we haven't even gotten to the point of your post about legally transporting the subject, apprehended out of State, across the state of Texas, which requires magistration at the closest location to the apprehension in the State. Please correct me if I am wrong.

Research this: Ark. Code § 16-94-201 et seq

and then a request on the Arkansas Attorney General by then Governor Clinton were the Arkansas Supreme Court to render an opinion, which way would they decide, RE: Prisoners signing intent to waive extradition as a pre=release requirement http://ag.arkansas.gov/opinions/docs/91-275.html

and finally, the codified answer to your question: Tex. Code Crim. P. 17.19 states that bail agent can obtain warrant from court before seeking to arrest defendant, and a judicial warrant is required to arrest with force, Tex. Code Crim. Proc Art 17.19 (Vernon 1977); see Austin v. State, 541 S.W.2d 162 (Tex. Cr. App. 1976). Uniform Criminal Extradition Act requires that bond agent or bounty hunter take defendant before magistrate prior to transporting over state lines. See Landry v. A little more effort on the research and less on being a smart ass might get you somewhere.

Most counties in my state require that everybody that bonds on a felony charge sign an extradition waiver as a condition of their bond. Further, I as the bondsman require that every person, misdemeanor or felony that I bond, sign an extradition waiver for me and/or my agents to bring them back. Does my state extradite on every felony? NO! Do I use my waiver to bring a person back? You better believe it!

I wrote a felony bond today where I know the guy works in Alaska, and has a very profitable business there. His business partners are tax clients of mine. I tried to convince him that I had only been there once as a teen, and that I really wanted him to pay for me a trip to have to come get him (while spending a little time exploring the back country), but dang it, he instead promised to go to court rather than paying for me to have a vacation. Oh well, at least I tried...LOL!
