I have no particular opinion on the 'ABC' organization... but I found this link on one of their pages interesting and helpful and as far as I can tell it is accurate. I think it would be helpful to the many questions that continuously arise on our site. I post it here for your inspection. I don't know many data bases that don't change periodically and checking facts with current info is something we all should do. As a matter of fact, I noticed upon searching the site... that Virginia is not listed with BEA laws. Virginia BEA people now are required to be licensed, a fact that is not reflected in the ABC bail law link so double checking as you say... should be done. However, I still think the link provides some good starting info to start someone on their path.

There was actually a judge that used that site to reference forfeiture laws on a bond forfeiture I had. He attempted to give me the 60 days "body or money" as opposed to the 150 days passed into law a year earlier.

Really ? A sitting bench jude referenced ABC as opposed to using current updated state penal codes ? That's foolish.

I know.........Intense . In addition, the court issued me the show cause summons well past the 45 day time limit after initial FTA that the state mandates. Very small county.

I don't even want to get into this but I will tell you a CA (Commonwealth Attorney) tried to forfeit on me immediately on one case and when I said, in as easy a manner as possible (I try not to pss off too many people by being a smrt azz in court) "I was under the belief that the law gives me 150 days according to Virginia code to find and return the defendant to court, before a forfeiture..." the CA in a real smrt azz manner looked at me with a smirk and said "I don't think so..." and the judge looked over his glasses and actually said... "let me look that up???!!!" I could not believe either of these supposed "know it alls" did not have a clue about this and then after the judge found the code... he looked at the CA and me and said "well Mr. Marx, looks like you get your 150 days..." ... and one more quickie for you to ponder.... I was in court 5 months after the FTA... with no show cause issued within the 45 days and the Virginia code was overruled by a general district judge with the statement from the bench.... "that code is for INTERPRETATION Mr. Marx..." I appealed and the next appearance I had my lawyer who got me out of the forfeiture.... but will someone straighten me out on something............ IS THE CODE OF VIRGINIA THE LAW IN VIRGINIA OR IS IT JUST FOR INTERPRETATION BY THE JUDGES??? I thought the code of Virginia was the law... period. BTW... Steve F.... I just read your email....
