Post subject: Going back to TN, if anyone needs help Posted: Tue 14 Aug 2007 08:34 |

Me and my fiance will be returning to TN within the next week or so to clear some more files. We just got back from five days down there, 12 captures. If anyone needs any assistance please let me know. We are mainly working out of the Nashville and surrounding 100 miles however since we're already there we can cover anything you need. Simply give us a call.

The state required course is only required for those actually writing bonds in TN. Bounty hunting all is required is be 21+, clear record, and a letter from the bondsman stating your employment.

The information you've been given is not entirely accurate. The statute that governs is TCA 40-11-318. If you are arresting someone who has fled to Tennessee from another state then TCA40-11-401 is not necessary, but if the case originated in Tennessee and you are working the case in Tennessee for hire, these two statutes are in play.

A pocket card certifying that the bounty hunter has completed the training required by this section or, if the bounty hunter is from a state other than Tennessee , proof that such bounty hunter successfully completed an equivalent amount of training in the bounty hunter's home state within the last year.
Considering I have Indiana's equivalent, then yes I am compliant. Thanks for the heads up, because I honestly did not know. The several bondsmans I talked to and local TN law enforcement were all under the impression things were as how I understood them. But fortunately I'm still legit

I'm not trying to beat a dead horse here, but I really believe that you are proceeding with faulty information. The section of the code that you cited refers to an out of state recovery agent or bondsman coming to Tennessee to arrest someone who has fled here from another state, and requiring them to have similar training crdentials as this state. Again, I would say that if you are in Tennessee and you are hunting a absconder for a Tennessee bail bondsman, there are no acceptable credentials except for those outlined in TCA 40-11-318 and TCA 40-11-401. I would in full disclosure have to admit that there are no judicial decisions clarifying this particular point, but I would hesitate to rely on information concerning bail recovery that came from law enforcement or the average bail bond company owner.

All Joe is saying is that if you are working Tn. cases for Tn. bondspersons, within the borders of Tn., then you are violating Tn. Law.
Everyone is simply trying to keep you out of jail. If you do happen to run into a cop who does know Tn. bail law, then you could end up in jail yourself.
Also, you are putting the bondspeople at risk as well as yourself, because if a solid defense attorney discovers your illegal apprehension of thier defendant, then you may face both criminal and civil actions against yourself as well.
Just trying to look out for you....

Both bondsmans I'm working for down there have been in business for a very long time, and also have just recently went through their annual "class" and they both assure me I am not violating any law. Sorry to stir the pot.

I tried to post earlier but it would not take . . . so here I go.
The guys are absolutely correct.
NOW you have to ask yourself WHY do Bail Bond Companies go out of State for their In State recoveries.
Matt, we are not trying to shoot you down , but rather looking out for you. Sharing the knowledge is what it is all about.
Joe Stiles is one of the best and most known in the state of TN. and was the sponser of this past Spring Seminar in Nashville.
mdbtyhtr (Scott M) is a well known instructor,
Mindtracker is also an instructor,
Me? . . . I just stay on top of my shit so that o don't end up going to jail because I was ignorant of an issue . . . there are others here that have not weighed in.
IF you are hunting an Indiana skip for an Indiana Bail Co. and you are certified in Indiana then you are fine
IF you are hunting a TN skip for a TN Bail Co. then you are not in complaince with TN law and that is that.
Once again ask your self . . . why

Well best of luck to you then. Just to add what LuVonda was saying, Joe Stiles was the former Continuing Education Chairman for the TAPBA....that position encompassed the ENTIRE state of tn. he is the foremost authority on Tn. law. He, and the 3 "Scott's" have been my instructor's/mentors since 2005. Of course your clients will say to you that you are legal. You're absolving them of their bonds...duhhhhh !
If leading authorities on this subject matter advise you that your clients are jeopardizing you and your team, then why would you not listen ?
To continue LuVonda's train of thought, why are these 2 clients hiring a BEA team all the way from Indiana to clean up Tn. cases when there are plenty of reputable, Tn. certified BEA's in the area ? What's wrong with this picture ?
I personally think that you are being lied to, manipulated, and taken advantage of.

I once read a post from you where you said your auto recovery business was booming, but the BEA work was slow. But you preferred the BEA work. So obviously you looked around for some clients that had enough cases to justify working out of state for an extended period of time.
