Well I'm glad I have ole mindtracker to interpret what I say. "For the record that is what I ment." nothing to do with BEA work. There are a lot of rual are'as here where it take's Leo's a long while to get out to them. For example about three months ago I spent about 12 hrs. Doing traffic control outside of the town of Marana when a bridge washed out. "With amber lights flashing. This was a request of the Marana P.D. They called up the police aux. I am part of.

As Mark has said, per Arizona Motor Vehicle Code, 28-297, the answer is no. Following is that section of the Code:

A person shall not drive or move a vehicle or equipment on a highway with a lamp or device on the vehicle that is capable of displaying a red or red and blue light or lens visible from directly in front of the center of the vehicle. Lights visible from the front of a vehicle shall be amber or white. This section does not apply to either of the following:

1. An authorized emergency vehicle or a vehicle on which a red or red and blue light or lens visible from the front is expressly authorized or required by this chapter.

2. A fire engine that is solely used for hobby or display purposes and that has been issued a historic vehicle license plate pursuant to section 28-2484 if either of the following applies:

(a) The lights are covered and are not activated while a person is transporting or driving the vehicle to or from a parade, authorized assemblage of historic vehicles or test.

(b) The lights are activated only in a parade, for an authorized assemblage of historic vehicles or for testing purposes.

C. Except as provided in subsection D or E of this section, flashing lights on motor vehicles are prohibited except either:
1. On authorized emergency vehicles, school buses or snow removal equipment.

2. As warning lights on disabled or parked vehicles.

3. On a vehicle as a means for indicating a right or left turn.

D. A vehicle may have lamps that may be used to warn the operators of other vehicles of the presence of a vehicular traffic hazard requiring the exercise of unusual care in approaching, overtaking or passing. The vehicle may display these lamps as a warning in addition to any other warning signals required by this article. The lamps used to display the warning to the front shall be mounted at the same level and as widely spaced laterally as practicable and shall display simultaneously flashing white or amber lights or any shade of color between white and amber. The lamps used to display the warning to the rear shall be mounted at the same level and as widely spaced laterally as practicable and shall show simultaneously flashing amber or red lights or any shade of color between amber and red. These warning lights shall be visible from a distance of at least one thousand five hundred feet under normal atmospheric conditions at night.

However, that is in regard to traffic hazards. Nowhere does it state for Bounty hunters, pseudo-law enf., or wannabe cops can run lights for bounty hunting purposes, which is what this whole thread is supposed to be discussing.

Perhaps I should have phrased my question more specifically: Where in the Az vehicle motor code does it state that bounty hunters are authorized by state law to use non-factory outfitted lights, regardless of colour, on thier vehicles for the purpose of bounty hunting in a manner similar to that of post certified law enforcement officers ?

In the code you quoted I did not see that section that specifically addesses this authorization. Perhaps it is in another section ?

Ruffin, I think that what he is saying is that it could be a plausible defense should he be reprimanded by LE . . . lots of gray areas - up to interpretation one could say. . NOT ALL LE's know ANYTHING about BEA work and depend on others to keep them advised, so the majority of the time LE most likely hasn't a clue (when it comes to our work) :shock: . Sometimes it is our best interest to educate . . . BUT then again . . . sometimes it is not 8)

I just talked with a division chief from the Airizona Dept of Public Safety. He said that the Motor Vehicle Code absolutely prohibits the use of any type of emergency flashing lights except for the vehicles four way flashers that come installed on your vehicle. He also said this has been tested in court at least ten times that he knows about and the DPS interpretation of the law is considered standing law.

And the part of the law that Green Beret (sic) didn't quote was the part that said they could only be used as a traffic hazard warning.

Now I guess if anyone wants to try and test it again, they certainly have the right but why would you waste your time and money?!?
