Another good one, this guy seems pretty busy.

He mentions that he has a CCW but wasn't carrying that day. My question (for my own edification and somewhat unrelated) is I thought I recall recently that CA either did or intended to pass a law forbidding open carry of an unloaded firearm, let alone loaded. Can someone from CA with understanding confirm? Just curious. (I need to update my state CCW and firearms law documentation for each state, and CA confuses the heck outta me)

Otherwise a good article. I see more and more folks in the industry when interviewed clarify outright this is nothing like the TV shows. Nice!

In CA we can carry an unloaded holstered handgun. You can have ammo in a mag with you.

There was a bill last year to ban open carry but I believe the governor vetoed it or it did not pass one of legislative houses.

HOWEVER, it will be back again this year as we now have a Democratic governor and an anti gun AG.

So it will pass and be sigend into law, for sure this time.

Now under CA Penal Code 12031(k), anyone can carry a loaded weapon while making or attempting to make a lawful arrest. The question is what is the time frame of "attempting" to make a lawful arrest?

That has been a problem for several recovery agents who have been charged with carrying a loaded weapon while working a bail skip case.

Excellent info, thanks Tony! Unless somebody out there (FRN or beyond) already thought of this, I'm going to work on consolidating the 50 states gun laws into one area so staying updated will be easier. I already put together something for 50 states bail and bail enforcement laws that I keep around, I'm just as concerned about going into another state to catch somebody and getting nailed for carrying a firearm, or carrying it "improperly", etc.

A California PI must also have a BSIS exposed firearm permit in addition to a CCW if they want to carry while working.

Yeah, we were waiting for this one to go through and had a feeling she would veto it. Fear not, there's another one under review (SB 1201) that will allow citizens to carry open or concealed firearms into public buildings, but would also require the building to establish a security guard and a metal detector.

And for you hunters, there's one awaiting House approval that allows hunting within city limits - SB 1334:

17-321. Hunting within municipalities
A CITY, CHARTER CITY OR TOWN SHALL NOT PROHIBIT OR OTHERWISE RESTRICT
HUNTING ACTIVITIES DURING AN ESTABLISHED OPEN SEASON USING SHOTGUN, RIMFIRE
RIFLE OR ARCHERY EQUIPMENT ON FEDERAL OR STATE TRUST LAND OR PRIVATE PROPERTY
