Karma is a Bitch ! Thank You Hurricane Sandy ..!

Well this is some Karma Justice for our defendant we had out on a very large bond.. $XXX,XXX.XX

Our defendant's last court date .. he did not show...

so the Judge on his case orders an A/C Warrant (Alias Capias - for the newbies) .. we started with the Co-Signer / Indemnitor.. she tells us supposedly she does not know where he is, has no contact, no phone numbers..etc... ( I call BS ! ) anyways.. long story short...through our connections and what not, we find out and confirm our Defendant re-entered into Cuba on a certain date and time and was hiding out there. Since we cant officially / legally go to Cuba to get this defendant .. apparently Hurricane Sandy went there for us instead and our defendant was killed in the storm. We are awaiting a copy of his Death Certificate and will motion off this bond hopefully soon.

Dont Mess with Mother Nature or Karma ! They are both Biatches !

Yup.. he probably was saying " I THINK THIS WAS A BAD PLACE TO FLEE TOO ! " but then again he fled there way before the Storm even became one.. but I am sure he wished he was back in Miami or Jail at that very moment... Drug Trafficking (Oxy's) was his charge.. Heavy Weight ..

Make sure that he is "really" dead. I have heard of cases of skips that went to Mexico and faked their own death with help from the whole town, to avoid capture and possible extradition.

In CA, most courts will require verification by the US Consulate in that country to prove the death of the defendant.

In Miami you can motion off pretty much any case ... its not hard like other counties in FL .. All they need is a copy of the Death cert... even if he were alive.. a signed affidavit from the indemnitor stating he is at this location (address) and phone # and we get off the bond.. since we cant go into that area / country..

A couple years ago in a bail CE class, the lawyer conducting the class told us a story.

A skip ran back to Mexico. He was wanted on serious felony charges that I can't remember. Anyway, he got his whole town to arrange a funeral complete with a casket with him laying in it.

They took photos of the service, had a program printed up and his death noted in the local newspaper.

So, there was a death certificate created. Some how the bail agent got all this "evidence" and presented it to the court to have his bond exonerated.

Well, a couple years later, this guy is arrested again and shows up in a LA court i front of the judge that presided over his first case and the bond exoneration hearing.

According to the lawyer, the judge said." I know you. You are Dead."

Needless to say many courts now require affidavits from not only local law enforcment but also verification by the U.S. embassy or consulate to authenticate the death certificates.

I do believe we will be getting official documents verifying said death..

Thats funny that this guy was lucky enough to go in front of the same Judge.. Dead man Walkin...

In our IDIOT state, NJ, .... We have to show the ORIGINAL death certificate, NOT a copy. Ever try to get one of them????, ... Go figure.
