Making an arrest in North Carolina

I have reason to believe that one of my skips may be in NC. I'm wondering if it would be legal for me to make the arrest myself being from out of state. I will verify my info before making the trip but I have never picked anyone up in North Carolina before. I looked over the laws and couldn't find anything saying that I couldn't.

Anybody from NC know if i'm good to go?

I am a Bail Bondsman in NC and the bail assoc. understands the law to say only bail bondsman from NC can re-arrest a skip for the insurance company that they are writing for. Nothing about out of state. If you are a bondsman you might get a bondsman in NC that works with your insurance company and get them to help. My best advice is call the NC Bail Agents Assoc. and the Dept. of Insurance. If you have any other questions send me an e-mail with your number and I will contact you. If you come here be careful and follow the law, because in some counties they will arrest you very quickly.

I would call sheriff's dept. of the county that you believe they are in, and see what they recommend. They are going to be the ones who you would have to be concerned with. If it is in a municipality, call the police dept. as well. Where in NC do you believe they are at? You can pm me if you'd like, I'm right on the border of TN and NC. I've worked with the sheriff/police in Banner Elk, Elk Park, Roan Mountain, etc. and they have no problem with us picking up skips in their jurisdiction (we notify them in advance of course, generally face to face), and they usually are willing to give us a hand if needed. If you really need a direct answer, you can try calling the district attorney's office of that district and see what they can tell you. As with everything in this business, it is best to start at the bottom of the chain of command and work your way up. Sometimes the way the law reads doesn't always mean that is the way it is enforced. Hope this helps.

Not all bail bonding companies are insurance backed. We are not. We are backed by capital we paid to the courts. What does the bail assoc. say about these companies if I may ask.

ok if i can verify she is out in NC i'm going to call the sheriffs department first and see what they have to say. Btw k1 I always dot my i's and cross my t's when I go out, so thats nothing to worry about.

BTW I believe the skip is in Cleveland County in Shelby, NC. It looks to be about 10-15 minutes from Charlotte. Anybody worked out there?

I have worked in NC, picking up my skips... since I am a licensed Virginia bondsman. LE in several jurisdictions that I have worked in northern NC have told me that it is fine for me to come after "my skips" but no one else's... this is also the way it is, as an example, in Florida which has no licensed fugitive recovery... out of state must be attached to either a licensed Florida bondsman or a PI or be a licensed bondsman from another state that is after his own skip... that is what I was told by several LE's when I went down there a couple of times....



Now that is an understatement!!!!!!!!!!

I have a 'pet' saying.... "the rule of thumb is there is no rule of thumb"... many times the laws are vague and/or non existent... and even when they do exist... they are not enforced... and then sometimes non-existent laws are enforced by un-knowledgeable LE.... for example... for many years I thought you could not carry concealed in SC.... I have since determined that that is not the case.... and yet, the laws on the books are so vague that .... "who knows?"

I believe you can go into NC after your personal cases if you are legal and licensed as a bondsman in your home state and you are after your case.

If you are a Professional Bondsman in NC you or your Runner can chase them. A Runner can only work for one Professional Bondsman. I hope this answers your question.

I have never had a problem recovering skips in NC, and have always made contact with the local LE first, and have often had my information run for warrants before they would grant me their blessings. I love the look when you tell them you are just checking in and don't need their assistance! I have also performed many 1305C from CA their with no issues and nothing but cooperation. Like anything, how you present and conduct yourself speaks volumes! I have left some recovery money in that state due to speeding tickets though
