CA New Proposed Bounty Hunter Rules and Regulations

PIs, licensed or "authorized" bail agents from other states can come to CA to pick up their skips in accordance with CA Penal Code section 847.5.

It is my understanding that the CA DOI has in fact issued bail agent licenses to some that have been convicted of felonies.

In one particular So Cal case, a fomer real estate peson was convicted of felony fraud and was still able to get a bail agent license.

NOTE: That isn't me!

However, it appears I will need to take the required classes for PC1299...

I do know of a couplee agents in our area that have Felonies. They were not financial related as far as i know but the DOI gave them a greenlight.

For any CA people that will want get to "certified" I would suggest taking the bail agent prelicense course before 2013. After that it may increasse to 20 hours up from 12.

And of course it will cost more.

Then you can take the POST 832 at your leisure.

Once the "new" 1299 goes back in, you will not have to take the security guard powers of arrest course. That wil save you 40 hours of class time and mucho dollars.

BUT, if you want some proof of fireaem training you can still take the security guard course and do the exposed firearm portion also.

Then you have recognizable firearms training and a permit. Even though the permit is not good for bail recovery work!

For those interested, there is a separate firearms section of the 832 course. Its cheaper than the BSIS course and goes with the 832 you're already taking.

Yes, that is correct.

The Bailspeak course will satisfy one of the requirements. And as Tom pointed out the PC 832 POST course would be the other.

Most community colleges and some adult night schools teach the POST Course.

I had a similar question regarding whether those with the 12-hour pre-license cert would be grandfathered in after the requirement changes to 20-hour. As far as a general grandfathering, I would think yes because, since the code specifically says the certs are for education purposes only and are not being used for their original intent (ie. law enforcement, security, or becoming a bondsman), they basically do not expire. The expiration dates on them are in regards to using them in their intended fields. Thusly, once you have documentation of EVER having completed them, I'd say you're good to go.

The problem we had on the committee is one side wanted no mention of grandfathering or requiring a date after which anyone wanting to be a CA BFRP, would have to take the classes.

Their assumption was that anyone that had previously qualified under the old 1299 would be grandfathered in. Anyone starting out when the bill took affect would have to qualify under the new law.

So, right now I don't know when those questions will be addressed.
