Hello Steve and Scott,

I am going to attempt posting a more conclusive answer to your questions. Both of you are hitting the area of how will Pennsylvania handle the issue of 'reciprocity'. In section five of SB221, it states:

(b) Out-of-State agent.--If the bail bond enforcement agent is not a resident of this Commonwealth, the agent must be licensed in the agent's state of residence. The license requirements in the agent's state of residence must be substantially the same as the requirements for licensure under this act.

What if a state does not have a licensing procedure...We are going to have to cross this bridge with our attorneys and those in the House and Senate. Scott, being in Maryland, I'm sure we are going to be talking further.

I would like to see the following addressed:

The bondsman who wrote the bond chasing his own skip into PA.
Acceptable Bondsman Identification, I.E.: Surety license, P & C License, Limited Surety License

An out of state bondsman chasing a client's skip

A list of States that have acceptable or similar training as PA proposes

Reciprocity for "Working CCW Permits" as opposed to CCW for personal protection, which should never be sufficient for this line of work

A pre-need application process for out of state people so that they can be vetted to the satisfaction and accepted as being properly trained by the state of PA, (out of state registrant) listed on a website or with the state police so the information is accessible to LE. This would address a need or procedure to be vetted so there is no last minute issue when hot on the trail, if you work in a neighboring state, get signed up, period. Not on the list, no work allowed?

A legitimate attempt to mirror DE training, identification, shield etc., so that we can establish precedence for a Nationally accepted certification, 1 state at a time.

Commercial truck drivers have DAC reports, which is a national database clearing house for driver history, infractions etc. and Bondsmen and Bail Enforcement Agents should have a similar opportunity with LE access.
We all know that they are much more comfortable when they know who we are, level of training etc. (How many of you have been run for warrants while surrendering a fugitive?)

That is a very valid concern, The PSP training and licensing is for recovery agents that are working for Bondsmen in Pa that do not currently hold any license. I live and work in Pa but most of the bonds I work are created in Delaware where there is state regulated licensing. The last thing I want, and I think everyone is in agreement in this, is to have to have a license in every state in the Union. That is why reciprocity of professional and firearms licensing is one of the main issues we are working on in this proposed legislation. If anyone wants to discuss this further please feel free to contact me offline. The more concerns we can give to the legal team the better but time is of the essence. Our legal team is meeting at the end of January to put together a presentation to take to Harrisburg.
