Alleged rape of schoolgirl: Accused granted bail
Jammu, June 26: Duty Magistrate Jammu M R Chak Monday granted bail to Sumit Singh Sambyal of Samba, who was arrested by Samba police on June 6, 2006 on charges of alleged abduction and rape of a school girl.
The counsels for the accused submitted before court that the accused was innocent and Samba police was harassing him in the custody.
The Samba police on the court directions had filed report in court mentioning that the accused along with three to four boys kidnapped the 15-year old 10th standard schoolgirl when she was going to school and took her to unknown place.
A case u/s 363/34 RPC was registered and search was started. During the
search police came to know that one car was standing parked at National Highway in which a girl was sitting, the police reached the spot and recovered the girl. The accused fled away from the spot. The police recorded the statement of the girl in which she said the accused committed rape upon her. Police got the medical examination of the girl done and case was registered u/s 363/376 RPC. Police arrested the accused Sumit Singh.
Advocate KS Parihar appearing for the accused produced photographs before the court and submitted that the accused and the girl were in love with each other but the parents of the girl were not willing to marry her with the accused.
The court observed that as per the medical exams the age of the girl is between 16 to 18 and after considering the submission made by the counsel for the accused and perusal of the police report has allowed the bail application of the accused.
Court ordered that accused be released on furnishing bail bond of Rs 20,000 and personal bond to the like amount. Bail Bond was furnished on behalf of accused.
