When ICE releases them to self deport, they are technically still in ICE custody, by alternate means (ROR) and are required to return to the ICE office with prove that they have arranged return transportation to their country, which is usually an airline ticket. ICE is at the airport when they leave and they have a special check in/check out process to verify that they left so that ICE can close the case and witness them board.
I just went through this on an immigration case with a valid I340 doc that was specifically not valid due to clerical error, the prosecution and the investigative arm of ICE had a disconnect. Had I notseen the discrepant information thqat was contradictory, Scotty could have been in some trouble, because they did not want the subject due to the above mentioned alternate form of custody and release.

Here in CA, for those that are from Mexico, they simply are taken directly to the border near San Diego, Mexicali, Nogales or El Paso by bus and released.
Some from Central or South America are flown at U.S. expense back home if those countries will take them. Those that can not be returned easily, some times sit in detention facilities for years.
We should try and clarify ICE bonds. Our company calls them immigration bonds.
Anyone that is NOT in the country legally by means of a visa, residency ("green card") or on vacation that entered through an official port of entry can be arrested and charged with local crimies just like anyone else.
They may be offered bail just like any other person. If they are not "legally" here, they can be reported to and in some states, they have to be reported to ICE.
ICE can place a hold on them and if they are turned over to ICE custody, if they chose to fight the deportation, a bail amount can be set for them.
Even those with "green cards" can be reported to ICE if they commit a felony or certain misdemeanors. So, they can also be given an immigration bail amount.
We had a regular bail client that had several DUIs and a hit and run. When he went in to renewal his green card, he was taken into custody by ICE and sent to Eloy, Arizona. His family spent tons of money to keep from having him deported.
He was granted an immigratiuon bail bond amount but, the family used what money they had to hire a lawyer to fight his case rather than bail him out.
So not all illegals get ICE holds or have to post an immigration bonds and not all immigration bonds are for illegals.

Premium goes in my pocket, collateral goes into a non-interest bearing fiduciary (big word like mayonnaise) account... held until the bond is adjudicated... all legal and proper.
This is what I say to everyone... and I mean everyone that calls me on a bond.... remember this, it lays out exactly what you do and how.
"I am in business to get people out of jail, each case is different and the particulars will vary but if we can work it out, you will get out."
I'll tell ya something else... when I write a fully collateralized bond... I don't get any information from anyone except the mailing address, SS and date of birth on the defendant, so I can return his collateral upon adjudication and finalization of the bond..... I don't even need an indemnitor. I have been doing it this way for over 10 years and have never been stung.
Only one other thing... do not accept credit cards on these type of bonds... cash only... cards have hidden problems no matter how solid they may appear.
The only bonds I won't write are Federal bonds and only because they are way to iffffffyyyyy and you never know what the Fed will actually do......... cause they make up their rules each day.... that is an absolute fact. I get calls on them all the time. I didn't know you wrote them. Heck, I will send them to you next time. Our insurance company's dosen't let us write them. I'd tried to get them to let us write them, but they just don't do them. We want to, but we can't find anyone that dose. We lose alot of money every time a call comes in.

Steve, my surety doesn't give me permission to write them either, but I am the bottom line on what I do and frankly, as long as I get full collateral, what liability do they have.... basically none... I am talking cash liability... nothing short of that... and I don't write all of them either... I still look them over quite closely... ... and please remember this Steve... you have known me long enough to know that I often speak tongue in cheek... however, there is always a bit of truth in all I say... I will never lie to anyone, I will however, sometimes not tell it all... but related to this thread... I do write them under certain circumstances... with close scrutiny... I have a pet saying as repeated in this thread.... "I am in business to get people out of jail... but each case is unique and the process differs with each... if the bond is doable... I will write it."
