A former North Carolina bail bondsman is arrested in Tenn. for kidnapping, and impersonating a professional.He was a bail bondsman until 06/30/07, but he was still contracting with bondsmen and general agents to do work. He was on his way back to N.C. from Ohio when he was stopped in TENN. and later arrested and the person from Ohio was released. This should be a wake-up call for any unlic. bail enforcement agents out there. Maybe Mr. Joe Stiles can keep us updated on this. He and I talked earlier today about this. No names mentioned here until the person is proven guilty or not guilty. Also, because me and my son may become involved even though we did not hire him, the GA hired him. If anyone has thoughts on this or opinions about legal outcomes, such as civil lawsuits or anyone being charged with acc. before or after the fact please let us know. Thanks for all the information you guys give to people here.

I have more questions than answers... Was he arrested for traveling through TN with a fugitive? If that is the case, I would think that interstate commerce issues would arise. I would be interested in the rest of the story. If Joe Stiles states something, it is golden with me. I actually love that big old TN Bear! I am kind of fond of his great wife and the Crab Smasher too!

Yes he was traveling through Tenn. to N.C. He picked the skip up in Ohio. Could all states charge him with kidnapping?

we don't know if it was an illegal apprehension because we don't know the individual or his/her credentials. We also don't know the origination of the complaint, was it Ohio LE? If it wasn't, then TN may not have had enough information to arrest the BEA. In my opinion, TN apprehension laws don't govern an activity in another state, hence my original post. As I stated previously, we don't have enough information to determine the legality of the arrest or the release of the fugitive.

If anyone would like to read the article you can go to www.johnsoncitypress.com and look under Bailsman imposter arrested in city. the bail bondsman was not licensed in N.C. and his license was suspended in 2007. In N.C. you must be licensed and work only for the insurance companies you are appointed with, no freelance hunting

I always hate to speculate on these cases because they could be misconstrued or give ideas to other enemies. However, there are certain items about this story that beg the question. How could law enforcement possibly have known what route the subject was traveling from Ohio to North Carolina? Too free with allowing the prisoner to access communications while traveling? Too much local exposure with the prisoner? If anyone believes the Johnson City Police Department caught this guy after solid police work, I'll sell you the beachfront property I have there. Secondly; Why was this person's credentials not checked? He doesn't have a driver's license or a bonding license? OK. Enough!! Here's his defense? If the arrest in Ohio was done within the guidelines of that state then, the only law he has broken in the state of Tennessee is Driving on A Suspended License. Tennessee has no jurisdiction over acts committed in another state, and the prisoner's imprisonment in Tennessee was a continuation of his arrest in Ohio. If any hotshot attorney wants my expert opinion on why this is so, please call. And, finally, kudos to the JCPD. If it isn't in NCIC, then I guess it just doesn't exist, huh? Lesson for today? Limit your travel. Hire experienced locals (Faircloth could have had this guy and had him on the state line probably in less than nine hours). And for Pete's sake, please make sure that at least your licenses are up to date.

A question, if the person that was being transported did have a warrant but not in NCIC should the bondsman that wrote the bond still be liable for the amount of the bond since he was let go by Tenn. If he is not liable what do you need to file

You can always put a motion in before the court, explaining your position and the resulting action on the part of TN, and request exoneration. The worst thing they can do is say no. But remember per our private discussion, that would eliminate your ability to not be involved in the action, or at least make it more difficult to prove you were not involved.
