So,
If you got a BSIS exposed permit under the security guard card, beware that is not valid for recovery work.
You can carry exposed under PC 12031(k) with no permit required. However, there are limits to how long before and after you make the arrest you are allowed to carry.
Send me a fax number and I will send you letters from the BSIS and AG that explains it all.

got the BSIS permit know it doesnt work but fig it cant hurt. Would love to see the rules though. I dont have my fax up yet but will get it to you soon as its up and running

With regards to your question under what conditions can a bail agent or bail recovery agent legally carry a loaded firearm, are either of them required to have a permit, which permit is required in order to legally carry a loaded firearm while attempting to make an arrest of a bail fugitive; and can either of them carry a loaded firearm exposed or concealed while attempting to make a bail fugitive arrest, those questions should be asked of the Bureau of Security and Investigative Services.
Penal Code section 12031(k) states "nothing in this section is intended to preclude the carrying of a loaded firearm by any person while engaged in the act of making or attempting to make a lawful arrest." As a bail agent or bail recovery person, they may carry the loaded firearm only during the arrest itself, not before or after. The firearm, before and after the arrest, needs to be transported unloaded and in a locked container.

This is in response to your letter of June 12, 2006, regarding your request for clarification on bail agents. The Bureau of Security and Investigative Services (Bureau) does not have authority over Bail Fugitive Recovery Agents (BFRA). As you noted in your letter, there are specific requirements for BFRAs. The sections that address these requirements are found in the California Penal Code, Sections 1299 through 1299.13. They were enacted by Assembly Bill 233, chapter 426 of the 1999 statutes.
California Penal Code requirements necessitate that a BFRA take the Bureau's Power to Arrrest training. It does not require them to have security guard cards. Some BFRAs have obtained guard registrations and firearm permits and believe they can carry a weapon with these permits. This is not correct. The guard registration and firearm permit are valid only when the holder is performing the duties of a security guard. The permits are not valid when the holder is acting as a BFRA.
I don't know what type of permit, other than a concealed weapons permit (CCW), would allow a BFRA to carry a weapon. I would suggest that you contact your local law enforcement agency or seek legal advice in this area. I'm sorry but the Bureau does not have the authority to give you an opinion in this area.
The only question left to be be answered is what is the time frame of being able to "gear up" before making the arrest. In front of the skips location? Around the corner? 2 blocks away??
Haven't gotten a clear answer form anyone.
