These links should be read and studied by all. You will be proud of some points, disgusted at others and come to a clear understanding that as recovery people, we are the lone voice in the wilderness. By this I mean that when a situation goes south, you are alone, completely alone. The bondsman that hired you, never met you and didn't hire you. The insurance company wants nothing to do with you because they were not involved in the hiring and or vetting process of the hunter. Law Enforcement, ever vigilant on mitigating their own liability will not support your behavior in any way.

What we do is dangerous. When you read the testimony, a fugitive's behavior is dismissed because the charges were misdemeanors or at least not dangerous and their actions by choosing to run are not a factor, though we believe that they are. Our actions to protect ourselves from potentially violent situations will absolutely be viewed in light of the defendant's charges, not on his actions.

That is why it is imperative that you seek out all available training and continuing education. Receive all of the information possible and practice discernment by eliminating that which is not acceptable to you or in your area of operation. Surround yourself only with trained professionals, you are only as strong as your weakest link. Remember that in our business, that we make a conscious choice to put ourselves into precarious positions and situations, we are not ordered to act or to respond to governmental directions to ply our craft. Therefore, if mitigating liability dictates so, you must back out and avail yourselves of all opportunity to retreat from a dangerous situation. You can never defend a shooting in your own defense, in our position as hunters, if you did not avail yourself of the opportunity to remove yourself from the situation.
If a situation is that dangerous, contact local law enforcement, brief them of the situation and work together to maintain the safety of the citizenry and yourself.

That statement was made to acknowledge that when there is an issue, everyone distances themselves from the issue generator, in order to limit their own liability. This is additionally evidenced by the number of Bondsmen that will never sign a Bail Enforcement contract unless it is mandatory to effect an apprehension and part of law.

Scott, I have never signed a contract with a BEA. I have sent them letters saying they have my permission to pick up the skip, but I word the letter putting the liablity back on them. I know I may still have some liability, but my attorney says this will help a lot.

The reason being, I am not there and in most cases, I dont konw the agent. If they are up to par, then they will have their ass covered as well, not to mention, wont put themselves in any position to get into trouble to begin with. I always tell them the money is not worth puttin yourself in position to get us both in trouble. I would rather pay the bond than to pay attorney fees for your actions. If there ever is going to be any questionable activity done to salvage a large bond, I am going to do it myself. I know that sounds bad, but its the truth. At least I can control to what degree and what direction the envelope is pushed that way. And if I have to pay attorney fees, I know it will be a controlled problem and not something completely ignorant. Not to mention at least Im paying for my own actions and not actions of others.

I completely agree with you and do exactly as you do as well as don't do. For those that have received authorization to arrest letters from me, they explicitly state that they are authorized within the scope of the applicable laws and not authorized to break or violate any laws, rules or statutes in place, and if they do, it is at their own peril.

A: Can someone please explain how in NY the Police let the bounty hunters take that poor woman away from a Police station, when the Police confirmed to the bounty hunters they had the wrong person??

B: I was taught if they are in NY - you need to have an NY BEA grab them. Was this out of state BEA's?

C: Why are all these incidents of people brandishing guns without seeing a weapon?

Also, nothing in the course was discussed about the interstate transportation regulations, so thank you LuVanda for that info. I will search this site for more info on that, as well as web.

ALL you need to know about the transportation of defendants is in the Dangerous Criminals Act of 2000

You must read it in the context of time. Some of those incidents predated current regulations.
There is no defense for an indefensible situation.
The information testified to was Ex Parte, you didn't hear the other side of the story, not that it made the incidents any better.

Any class on fugitive recovery should include the transport of defendants across state lines, and the UCEA should have been addressed in class as well.

Sadly, it wasn't. We discussed nothing about transporting other than what States we can go in, which ones we can't. I keep all my training booklets and papers in a 3 ring binder. I did finally get my DCJS 99# finally, and once I get all my stuff from VA, I would like to buy you lunch if you know of some place in Maryland where we can get a meat 3 & tea and you can see what was & wasn't covered, because it's what wasn't covered, that worries me most. I have been reading the Act of 2K thanks to LuVanda.
