http://www.timesnews.net/article.php?id=9005721 Judge sets new bond for accused Kingsport child rapist Donald Lynch; trial date set in one case Published 03/28/2008 By Kacie Dingus Breeding Retired Senior Judge Jerry Scott approved Donald Lynch's request for a new bond during a Friday morning court appearance. Scott set Lynch's new bond at $1.5 million, Sullivan County Assistant District Attorney Barry Staubus said. Scott also scheduled a motions hearing for May 2. Staubus said he expects Lynch's defense attorney to make a motion to suppress incriminating videotape evidence at that time. The evidence involves about 63 videos that were found in Lynch's possession. According to court records, Lynch's voice narrates as juvenile females assume sexual positions and engage in sexual acts. Lynch's attorney may also request a change of venue, Staubus added. While Lynch faces over two dozen cases in Blountville court, Scott set only one of them to go to trial for now. The case now set for trial is the one with the most counts, according to court records. It is set for June 9 and is expected to last more than one day. The charges Lynch will be tried on include six counts of rape of a child, two counts each of aggravated sexual battery and especially aggravated exploitation of a minor, and one count of unlawful possession of a firearm by a convicted felon. In all, Lynch faces 11 counts of rape of a child, 38 counts of aggravated sexual exploitation of a minor, five counts of aggravated sexual battery and one count of unlawful possession of a firearm by a convicted felon -- all felony charges. He was arraigned on these charges before he disappeared in 2004 after posting his previous $200,000 bond. Authorities brought Lynch back to Sullivan County on Nov. 19, 2007, after federal authorities nabbed him in Matamoros, Mexico. Lynch is accused of recording and possessing 63 home videos in which a man, believed to be Lynch, narrates as juvenile females assume sexual positions and engage in sexual acts, according to court records. Trial dates have not been set in any of the other cases pending against Lynch, Staubus said. However, Scott is also presiding over a case that will determine whether X-Cell Bonding Company will have to forfeit Lynch's previous $200,000 bond, Staubus said. That case is set for April 16. Representatives of the bonding company have appealed the forfeiture notice twice. During one appeal, bounty hunter Jeff Kiser claimed during a May 10, 2007, hearing that the Kingsport Police Department impeded his ability to nab Lynch. |
