If that should be the case then the Judge that set "bond" should be held liable. Collection of a bond should only be possible FTA and failure of the surety to recover said person. Death is an excusable absence from a courtroom . . . Of course of thought this would be a "reasonable" assumption |

in this business, we write appearance bonds. We do not guarantee behavior, actions etc. Anymore than the court does when they release people on ROR. This is a matter of contract law and not the judge's personal opinion or attempt to legislate from the bench. this case should be overturned by appellate process, albeit an expensive one, and whomever the indemnity is will bear that expense, also contract law. The judge's incomplete understanding and application of bail law as well as bail contracts and the specific language of bail powers that iterate appearance only is appalling. Were the appellate court to uphold this ruling, they could not do so separate and apart from implicating the judge that admitted this person to bail in the first place. If you want them held without bond, say so. You cannot Infer that a high bond is un-attainable by anybody. Scott |

Can someone enlighten me or point me in the direction of the "legal precedent" that Judge Krom refers her decision to? I can't seem to find it in the Pennsylvania Code nor within the decisions on both the Pennsylvania Supreme Court or the Pennsylvania Attorney General websites. |
