Wow, this is a very scary and shocking verdict.

These guys did not properly notify LE of their activities, did not have any clothing identifing themselves and if I heard correctly, they were not PC 1299 certified.

But, If it went down as reported in this article . . . then it was a good call by the Court.
They may have not been compliant, however, what the Officer did was not right and to have lied on top of it to "justify" shooting the man is just plain ole wrong.

The reason they went to a federal court was that they sued for civil rights violations, use of excessive force.

Initial reports were that the "recovery agent" did turn facing the cops with the gun pointing towards the cops.

I have inside info that I can't repeat other than, I know someone that testified as a witness in the state case.

By the use of excessive force. That was the claim.

Interesting outcome.. I heard a story of an agent that ran up after a guy who just got in his car and got ran over pretty good. (dont have all the details) The agent had no identifying marks on him except a badge around his neck I think, and he lost the case because of that.

This case was filed in federal court because the rules regarding evidence, etc are slightly different than in state courts. At least that is what I was told.

So they thought that they had a better chance of winning in federal than in a state court. Many police abuse cases have been filed and won in CA state courts, so I kind of believe that they went to federal court for a reason.

If someone knows more about the federal system, please enlighten us.

The main reason I wear a full duty belt when we do recoverys. May not be easy to hide but sure is a good indication "bad guys usually dont wear duty belts". Keeps me safe :P
