There are many bondsman that are just as bad or worse than the people they bond out.
If he did this he deserves everything he gets if not the press just sank another person.
Off hand it sounds if he wrote a bad bond in the first place.

Something to look out for...as business continues to become more sparse, and bondsmen become more desperate, these types of things will start to flourish. I have always been a proponent of multiple revenue streams. Multiple sources of revenue eliminate the need to become challenged when 1 revenue stream ceases to act as expected or fore casted. People that are new to the business, that write panic bonds, will accept short money on the promise to pay. You will never have a better opportunity to collect your money than when the defendant is still locked up. When you agree to accept short money, you have to be prepared that the money collected up front is all you are going to get. You have a civil remedy to your situation and that does not involve armed men attempting to collect bail premiums under the threat of force.

This is very important to new Bail Enforcement Agents eager to please a new client. Do not collect any money on behalf of your client, period. They have a civil remedy for that and it does not include you. Nobody has power over you that you do not allow them to have and this is a perfect example.

What further compounds this problem is that the write up indicates that he did not get paid at all, at least that is how I read it. This means the guy was bonded out on a promise to pay, and that is just stupid. The control of the entire Bailee/Bailor relationship was determined by the defendant. What starts out bad, does not get better...

I may preface this with this statement... Today's economy and the political climate in the bonding industry nationwide has created a very slippery slope for our industry. The influx of new blood... mostly unqualified in terms of experience and looking to make the big buck immediately, has created an environment that is detrimental to us all... new and old alike... I never financed bonds in the past but today... I do what I have to in order to continue in business... but I am still extremely wary of who and how I do the financing... having said this....................



There were two major things that I learned when entering this business.........

1. Write the bond, not the premium...

2. If you have to finance to get the bond, be extremely wary and never take less than 65 to 75% down and the balance in 2 weeks or less and make all parties totally aware of the consequences if not done according to the contract.

... and one other unspoken secret that will make or break you.... "INFORMATION" is the word... you can never have too much, but you can damn sure have too little....

... in other words, look at the bond first and the money second...

You are in the bond business, not the banking or finance business. If you chase anything it should be the defendant, not the money.

I will be the first to admit that I do finance bonds to some degree, but not zero down and payment later... I will offer to finance 35% in 2 weeks with 65% down and that is only in very, very scrutinized situations where I have a tremendous amount of information on everyone involved. If the money is not forthcoming in the time prescribed... I lock the defendant back up and come off the bond... now this is not always possible in some states, but in Virginia, I can lock up a defendant if he violates bond conditions and contract violation is one that will suffice.



There was a time in the not too distant past, when a bondsman could be a felon and operate in certain states... Virginia and others now have controls on who and how a person gets into this business. This does however, still leave the door open to those that would enter the trade, who are not....... shall we say........ the cream of the crop as to character, morals and general ethics... I suppose as long as you can pass the tests, pay the money and run off a few business cards, you can get into this business... staying in it for a long period of time and building a solid reputation takes time.

We actually just got a call... 5 minutes ago... from a guy that wanted out and would pay us Friday when he got his check... what do you think I told him....................... 8)

Well,

He has been in business for about 9 years. So one would think that he knew the right and wrong way to write bail.

It appears that he went out on his own in 2006, so he must have been working for another bail bond agency.

I do not know if this is the situation in this case but, many bail agents work for larger, statewide bail bond companies. Then they go out on their own thinking that they can out do their former employer.

Fortunately, yes fortunately, they screw up because they don't have the resources of the larger bail companies and hopefully they go out of business quickly.

Tony, it appears that Virginia is losing bondsmen on a daily basis... I just completed my CE biannual classes and I was the only bondsman in the class of about 25 insurance agents... the only one...

Two have dropped out in my AO in the last 6 months and my daughter got a call from a friend who said he is leaving the business this year and did we want his phones... this is the second one to offer us their phones since January.... it is getting really tight around here...

Having said this... there also seem to be a few new faces on the block which reflects a few coming in as a few leave... one of the new members approached one of the county sheriffs and complained because his number wasn't on the list... the sheriff, who doesn't particularly like us anyway... decided to completely remove the list from his jail so now unless you are in the local phone book... you don't get a call out of that jail.............. I AM IN THE BOOK.... TWICE :mrgreen: :mrgreen:

Just a lot of stuff happening here... I hopefully can hold on during the transitional times.... I'm fairly solid but ya just never know.

Oh, and another newbie is sitting outside the jail soliciting... absolutely a no, no... and if caught by the right person... will be removed from that property... maybe the business.... gee...... that would be tough... 8)
