Need to make my previous comments clear. In NC the clerk of court has 30 days to mail a Notice of Forfeiture. The forfeiture shall be mailed to the Bondsman/Insurance company within 30 days of the actual FTA. The clock starts running once the forfeiture is mailed.

I re-read what I posted earlier and the remarks I made confused me!!

The point I was trying to make was that even though the 30 day statute is in effect I've read where the courts have not followed this statute in NC. In several cases the courts ruled that the Notice of forfeiture actually took place once the forfeiture was entered into the system.

If interested, you can read NC bail bond court cases and see where this has happened numerous times.

I have had similar issues in MD, specifically one case with no notice after 1 1/2 years. This was discovered when I was getting exoneration and they refused to give me one. This case had no active warrant either, as the Sheriff saw the FTA and signed and returned the warrant to the court as having been served 1 week before the warrant was issued. The administrative judge told me that you are correct, you need timely notice and I am giving you 90 days from today, that is your notice! He also graciously reissued the warrant and gave me a true test copy! I caught the guy in Columbia, MO and the day I surrendered him to the jail in Easton, MD he was ror'd.
We all work in screwed up systems with inconsistent application of case law, but I could pick him up quicker than fight it with the same results.

Well, looks like two clerks of court , one bondsman and another person acting as a bondsman, but not licensed, has been indicted in Wake County.

I won one and am due in court on the second in this series...

first was in circuit court the one I am into now is in lower court... general district, if I can win this one, I think it would be a 'Precedent'... and that would be something that hopefully would help us all... at least in VA.

I went to the circuit court Monday and got an order signed by the judge on the first case so I have that if the lower court asks for documentation.

We, as bondsmen, are held to a very tight reign... made to follow orders and codes to the letter... I only ask for all in the business, on both sides... to follow the same rules... rules are rules and they should hold on all involved... that is what they are there for....
