Bail is set at $10,000. The person has $10,000 and more in the bank. Fat lot of good that does...it's in the bank! How do they pay bail when their money is in the bank?

Have someone go to the jail and get apower of attorney signed for access to the bank account and let them pay the bond.

I don't know how it works in other states or with other bondsmen... but first of all... here in Virginia, the defendant cannot bond himself, second, I have to have a strong indemnitor on every bond and if the defendant has the money for the premium, in an outside institution, the indemnitor can usually get his/her hands on it with a bank card, check, or power of attorney... but the money will be in my hands and a good indemnitor will have signed all paperwork... BEFORE the bond is written.

There are a number of bondsmen in my AO... that will get someone out... without money, without an indemnitor and then worry about getting both after the fact... more power to them... I am not in business to chase money or indemnitors and if that is where I have to go to stay in business.... well, I still have my CDL.

But for a direct answer to your question... "They don't pay when they are in jail." although they may pay when they get out of jail... I have bonded defendants that have all the premium 'on the books' and an indemnitor that is aware of that fact and both parties are advised that upon release, the jail check goes to the bondsman. But that money is on the books and not in an outside institution.

Sometimes, I respond to stupid questions with stupid answers... then again I sometimes respond to stupid questions with serious answers because there may actually be someone that needs a truthful answer...

Obviously Mr. Tom has a history on here that I was unaware of.... but of course Miss L is all knowing and I bow to her knowledge in this case.

So confusing??? When I try to be funny, the posts get real serious... when try to be serious, the posts get funny... I give up...

OOOOOOhhhhhhhhhhh........ now I see... I had almost forgotten... I apologize... we don't have a lot of intellectual meth heads where I come from... just a lot of dumb pot growers and moonshiners... but were trying to upgrade our crimes... please help...

Thanks for the info. It seems like using a power of attorney to withdraw the funds in the answer I was looking for.

Ok,

To be serious like my brother Bill for a moment, to use a power of attorney, most banks will require you to use their POA form. Not a generic one found at Staples or online.

It will have to be notarized and include pictiure ID of the defendant.

I know because that is how I had to do it here in my AO. I will bet that most other banks will require the same.

Now, when I say that I had to do it here in my AO, I do not mean that I bailed someone out with a promise that they had the money in the bank. I have performed notarizations for inmates at the request of other family members, etc.

My operating rule is, no money up front, no bail up front.
