Okay, so the bondsman has to pay say $5000 or produce the defendant. Defendant is wanted in East Carolina and skipped to West Dakota. Bounty hunters apprehend and, as required by the local police, bring the person to the police station. East Carolina won't send anybody to West Dakota because it's not worth it...so the defendant goes free, but the bail bondsman still has to pay up. Does that happen? |

Unfortunately yes it does. As I'm sure Bill M. Will tell you what his judge tells him: "get used to it...part of the business." i don't know your particular state statutes, but you could try filing a court motion to have your bond set aside because your DA refused to extradite. You could cite a Ca. Statute 1305 G or something similar to it to support your motion. Maybe it'll work, maybe not. |

It did not use to be just part of the job but as Ruffin said it is getting to be business as usual as the money crunch keep city,towns and states from extraditing people. You can try and have it set aside but that is also starting to do no good. Now it is up to the bondsman to pay the bond or go get the skip themselves and return them on their dime. a lot of times it is just cheaper to pay the bond. But when i wrote paper i would go pick thier ass up just because. I have went to CA from louisiana on a $1500 several times |

At least here in Indianapolis Indiana, when necessary, the bail bond company simply agrees to pay the extradition expenses incurred by the sheriff's department. |

Like Mr. Martz, I will pick them up almost regardless of the bond amount and the distance I have to travel. My latest was the projects in Detroit. This, at times can pay off....Once word gets out that you've gone to such extremes to apprehend a skip who is far away on a small bond you get a pretty good reputation among other would be skips. I have one in North Dakota right now that I'll pick up soon. His bond is 10k however. |

In Maryland, in order to get the fugitive listed in the NCIC, you must agree to pay for the extradition. Usually, part of my deal is that they enter him as extraditable from the state he is located in, and we are authorized to do the transport. Some jurisdictions consider magistration, as in the UCEA, as asking the defendant if he is willing to leave the state with us, thereby waiving extradition, or they have the right to fight extradition, and then they will be charged with fugitive in flight of justice, failure to register as a felon in the new state and unauthorized flight to avoid prosecution. They are also informed that any time that they spend in jail fighting extradition is not concurrent time, and when convicted, their time starts anew. I have left with the defendant after this type of abreviated magistration process, and I have had prisoners held until they tell us when we can go get them. It doubles the cost because you have to make the trip twice. I have been exonerated on bonds after causing their apprehension through networking and still made the trip and paid for the transport back because I do enjoy the local cooperation and don't want to jeopardize my relationship with the locals. I have been told off of the record that not all bondsman are afforded this level of cooperation. Scott |
