Hi just a quick question.if a major bond jumper fled to Europe skipping court.can a bounty hunter get a warrent to go and personally arrest the fugitive and transport him back to USA to face charges.can a bounty hunter legally do this with going through the correct procedures.or will you need the european police to arrestthe fugitive and you pick him up at the other end.any help you guys and girls can offer would be great. |

The simple answer is no. Most European countries have very specific extradition laws and in many cases (such as the UK) it is illegal to bounty hunt. Without going through the proper government channels, you would open yourself up to all kinds of international legal issues. |

The U.S marshals have the responsibility for returning skips from foreign countries. Even then, the local or state authorities must make the actual "arrest." A private citizen will never be given a "warrant" to make an arrest of a skip in a foreign country. |

The legal process is a triple sealed warrant. The 1st in the wanting jurisdiction, the 2nd when the Feds are asked to assist (UFAP Warrant) and the 3rd issued by the country or applicable jurisdiction wherre the defendant is located. It becomes more complicated when time is involved. The bond may go to summary judgement before the extradition process is completed. We had one recently in Vietnam that was successfully recovered, thanks to some very sharp and on the ball FBI Agents, who was taken into custody and when formal extradition proceedings were initiated, was summarily expelled from the country. Much more to the story, but that is all that I am willing to share. Scott |

Just for clarification. When I stated that the local or state authorities must make the actual arrest, I was referring to those in the foreign country, not in the U.S. We had a runner in the Philippines and had to go through the process that Scott mentioned. The local authorities could not act uuntil we had all the paperwork from the local DA, state department, U.S. marshals in order. |
